The seller will only offer a full refund as he says the post must have damaged the saw and that it was fine before he send it. I have to cover the return postage whack seems a bit unfair since he was the one selling a damaged item. But I'll be rid of the saw which is a good thing I guess.

Hmmm, I find that hard to believe. I suppose anything is possible, but it would have to have gotten under something very hard and very heavy. I would imaging that anything that was sharp-edged enough to crimp the saw plate like that would have also done some visible damage to the wrapping & packing.....

Returning the saw is not a good outcome for you. This seller passes quite a few tools though his hands. He would have known about the kink or it was a gross oversight on his behalf. I agree with Ian that damage of that sort is hard to imagine in a context of postal delivery.
I would suggest that you contact him again and explain that you would prefer to come to a discounted arrangement with him rather than refer the matter to PayPal's dispute centre and perhaps he would like to re-consider before you take that step.

I can believe that it could be damaged during shipping, but for it to have been bent parallel with the tooth line in random damage like that seems highly unlikely to me.

A further thought is that the handle of a tenon saw is very vulnerable compared to say a handsaw. It sits well proud of the sawplate. For such damage to occur, which in itself is very unlikely, I would think it is almost impossible for the handle not to have sustained significant damage. In fact it would be the first casualty.

I asked to seller for a partial refund and he escalated the case to customer support who decided to issue me a curtesy refund, so now I have contacted Klaus and Pedder for a new plate.
