Got caught on eBay
Saw this ad on eBay
eBay Australia: Buy new & used fashion, electronics & home d
Fell for it and bought it.
Turned out, it was not in the original packaging as shown on the picture, just a DVD folder with a disk inside.
Registered the program and contacted the seller regarding the missing parts.
Cheeky soandso answered that he never said the book came with it and that's why it was so cheap and if I want to I can return it at my expense and get my money back, minus postage.
Well, new means an unopened package as sold by retailers.
So I have now opened a PayPal dispute, will see where it gets me.

Should have them pretty good. The ad says brand new and sealed.

Add clearly says "Not EDUCATIONAL version"
the educational version is sold as the disc only
Towards the bottom, the item description includes "hard cover, full-color, printed Guidebook available with the box version" if seller wasn't selling the box version, that would need to be clearly stated -- and I can't see where it is.
I'd be inclined to report the so-and-so to Fair Trading or ACCC and insist on full refund including all postage
If you've installed the software, check the version number -- I'm pretty sure the Educational version has a code distinguishing it from the full version. Possibly a pop-up notice or banner saying "not for commercial use"regards from Alberta, Canada

It does say at the manual is included on the disk, which might be said to imply that the book version isn't there. Not at all clear though.
The other day I described to my daughter how to find something in the garage by saying "It's right near my big saw". A few minutes later she came back to ask: "Do you mean the black one, the green one, or the blue one?".

Yes, the manual is included on the disk, but when you buy the FULL boxed version -- which everything in the add implies is what is being offered for sale -- especially with the words "NOT EDUCATIONAL version" included in the item title -- you also get a hard copy of the manual.
CorelDraw comes in three flavours: Full retail (comes with manual); upgrade (no manual); Educational (no manual)regards from Alberta, Canada

this sounds lke outright decepive conduct
From what you've posted the transaction was a "sale" not an "auction" -- do the so-and-so through Queensland's Frair Trading or the ACCC
In the item detail, it's clearly stated that the book is included in the boxed version you bought
tell him to refund 100% of purchase cost PLUS the cost of the return postage or send you the book for freeregards from Alberta, Canada

Well, I must have him worried.
Got an email from him today offering the missing parts, however, he does not have a spare box.
"He didn't know one of the staff had changed the eBay ad"!!!
YEAH and pigs fly too.
I don't care about the box as long as I get what I paid for.

Have you got a friend with a PO box?
Send him a blunt letter demanding the result you want and end the letter by saying you're fed up dealing with the matter and that he is to refer future corresponse to your solicitor - invent a name, put "Barristers & Solicitors" after the name and your friends PO Box.
I've used this dodge more than once to good effect, people tend to back down if they think you're serious enough to go legal.

Saisay, you probably got what you paid for. Looking at what other sellers are charging you probably paid for an upgrade version, however that's not what he/they advertised. Whether he made a mistake or was trying to pull a shifty that's not your problem, you are entitled to receive the goods that were advertised at the price they were advertised.

Dispute closed
I received the book and boy is it a big heavy one.
Definitely not suited for bedtime reading, my arms are aching after a couple of pages.
Funny thing is, on the back cover is a printed price of $50US.
Makes me wonder how Corel can justify the price difference between upgrade and full priceEvery day is better than yesterday
