    Poor Arthur and Lindsey. Lovely people, but no idea when it came to milling, really. I hope they get it sorted out and move on to something more suited.

    The CTTT provides a relatively informal forum for resolution of disputes of this type. It is also low cost. Both sides have the opportunity to put their case in their own words. The result is binding. Can be a bit drawn out though.

    Reading the information in this case I am surprised that it is publicly available. Without judging the merits of either argument it is great to read the dispute resolution process. Tough time for both parties involved.

    It seems a shame that when you buy a new car, tractor, boat, bobcat etc that you dont get any induction or training with that machine because it is assumed you know what your doing with it. Sawmills can be a different thing here and that to me seems to be the problem in this case. I hope it works out ok for both parties.

    yes but all those things you require a licence or ticket to use them around otehr people where you can hurt someone.

    sawmills are the same.

    this is not an operator error issue IMO.

    Not saying that it is user error Carl, nor product , more service and supply IMO. To be the manufacturer or distributor of any product in the modern day legal minefield means that such cases as this will come up. And the more demand for your product, the more likely it can happen, but thats basic maths i suppose.

    I can't see at all how this is a matter of operator training.According to the Tribunal documents:


    • The guy paid 16k for a sawmill in Feb 2007 and Ecosaw didn't deliver it until May 2008 - how long does it take Lucas or Petersen to deliver a new mill that's paid-up in full?
    • EcoSaw advertised a 'telephone hotline' and then didn't answer calls, messages or emails - have you ever called Lucas and Petersen during business hours without getting an answer?
    • The gearbox blew up after 100 hours of milling. 100 hours is a fair amount of 'training', but a bloody short life for a gearbox on a machine with a 5 year warranty.
    • It then went to the Tribunal hearings on 3 separate days over 7 months and Ecosaw didn't turn up once to present any evidence in their own defence, nor did they send any documents such as a report saying that the mill was either working or had been misused.

    If you ask me the only training required here is for companies not to promise what they can't or won't deliver.

    Good reputations are built on good products backed up by good service. The opposite is also true.

    As far as I can tell this guy got taken for a ride by a shyster, and then got a bit of belated justice.

    That's my reading of it.

    Darkwood,the operator training thing to me has alot to do with it when buying a sawmill in my opinion and should be part of the deal from the word go before even putting down a deposit let alone 16k in full. How many of us on this forum who own a sawmill could at least say they were competant with such a machine prior to purchase. Having put down payment in full, after 30 days shouldnt alarm bells be ringing if you cant get someone on the phone, not 15 months later get your gear and hope for the best because in the back of his mind hes thinking thank god i havent been ripped off. The gearbox issue in this case is disgusting. My computer on my woodmizer failed after only 12 hours of work, the 3.5k component was flown from the USA and landed on my doorstep in 3 days, no questions asked. I totally agree that the guy was taken for a ride and got belated justice. But had he taken action sooner this would not be public information, as had the provider provided a better service and product it would have all been avoided.

    well well. was only a matter of time by what I could understand. Arthur should consider himself lucky that he only had to refund what the guy had already payed him, and not had to pay compensation for injuries incurred by using his poorly disguised abortion of a lewis mill. There are many companies out there who should face similar actions, to amounts far exceeding the trifling amount that this case has affronted. I know of one company which has burned individuals to in extent of $200,000 on numerous occasions and still is trying to, which have not met this fate, BUT SHOULD!!!

    At the end of the day if you are going to advertise a product and sell it, expect repercussions should it fail to be serviceable!!!!! Do the research and develop the product before expecting some poor gullible mug who needs a solution to a problem buys your supposed solution!!!! DO NOT promise something you know cannot be done or send out a product untested or unproven to do what you promise. If there is an inkling of doubt in your mind or one of the guys manufacturing the products mind, re-engineer it before sending it out to the unsuspecting customer and having to try cover it up. Make the product reliable, serviceable and of a standard which you would expect if you were the buyer, DO NOT sell a product to a customer knowing that it is not up to scratch because you have your nuts on the line and have to make a deal to pay creditors, it will only cost you more, and unless you are dealing with large tattooed men who ride things over than horses and play with guns other than those which shoot paintballs or water, you will find that most will accept that you need a bit of time, rather than forcing you into a position where they simply cannot ever recoup their outlay.

    sounds like justice was served in this situation!!!!

    Get your handsaws sharpened properly to the highest possible standard, the only way they should be done, BY HAND, BY ME!!! I only accept perfection in any saw I sharpen.
