    Default Police dumping rubbish, what do I do?

    My block is suburban but someone dropped a large tipper full of rubbish on my block (this is not uncommon) a friend was carting it to the tip after removing 1m of plaster he came across the remains of a hydroponic dope growing set up (all destroyed). I was there today cleaning up the last of it and a bloke living near by come to check me out. After we checked each other out he tells me that a factory near him was raided by the cops and they loaded two tippers full of stuff. It looks like they kept the one full of dope plants and dumped all the rubbish on my block.
    Well my question is what do I do? Normally if you found out who it was you would go to the cops, but what do you do when it is the cops?

    if you have the proof that this is what happened then it is easy . your local council would love the story as they are always bliting this sort of thing.. so the answer.... ask the local epa inspector that works for the council and a local newspaper reporter to meet you on site tyo discuss the resultion. after all if they are dumping on the council nature strip and your property it is their buisness as well as yours. the local paper will just ensure the follow up. good luck

    They didn't dump on the nature strip backed onto the middle of the block. It is all cleaned up now because we didn't want it to look like a good place to dump.

    I would approach the EPA ..... they are very big on dumping and may be able to offer you some pointers.

    Go to the police anyway.

    They have probably contracted an independent company to dispose of the rubbish, and have no idea it was dumped on your block.

    I went to see the constable who arranged the search warrant and he explained how it was from elseware but was very interested. I was left with lots of plant bases and he said they have to pull the plants out with root matter on to show they are plants. So someone nearby must have been a bit worried. The council told me that they would have cleaned it up with 8m of it it may have been worth the effort to tell them.

    Just in case anyone is interested the same gentleman came back and dropped another load (just rubbish this time) so I went to the council and they said sorry nothing we can do. I took photos of the tyre tracks and my friend said they were the same tracks as last time. Single drive tipper 10-00-20 tyres distintive non matching highway pattern on rear. Gave info and photos to police.
    After much effort I found the truck took photos gave to police they said enough evidence to convict. I asked what will happen told he; may be fined 20K but you want see any of it. Will he have to clean my block? No we may be able to go for compensation.
    So I went to see the gentleman told him I'd been to police but would prefer not to go to court and asked him to clean up his mess and seeing we had removed his last load I said he could cleanup a load of rubble that was dumped years ago. He agreed then wanted to rent by block to store his bins $500/week.
    I was told he and a few of his Lebo mates hire blocks dump rubbish to no more will fit them move on. I was told of a fellow in Sunshine who had a block and was quoted 100K to clean it up and he hasn't got the money. So I sad no.

    Despite your arrangement I would still be providing his detail to the EPA. He has tried his luck at illegal dumping on your block ..... been caught out and as a result will just have to remove the two loads that he initially dropped at the same cost as if he dumped legally. He has come out without a win but also without a loss.

    Given his track record he isn't going to learn from this situation. He is going to try it again elsewhere and looks like he will get away with it again. If you didn't put in all of your hard work you would not have been able to track him down.

    Tell the police that you have tracked him down and done a deal just to get rid of the problem as it was going to be a better result for you than having him fined and the rubbish remain. The police seem to have been using him as a private contractor and given his history this arrangement should stop.

    Having him remove the previously dumped rubbish is a good result for you but there is no negative for him. You have a chance to stop the same thing happening for other landowners who are in the same situation as you before you managed to find him.

    I do feel a bit guilty. It was a toss up me down maybe a few hundred and him down 20K or me up a little and him off the hook for next to nothing. I also spent about 10 hours and fuel to find him. (was thinking it would be a good job if you got paid for it).
    There is also the possibility that the magistrate could find him innocent especially if he hires a good barrister.

    what you need are those stinger strips they use in police chases !right across the frontage. ah revenge is sweet if not practical .perhaps some fencing? best not to make the problem bigger. cheers bob

    I work for the EPA here in Tassie and such an illegal activity is a prosecutable offence here, especially with correct and admisable evidence. If it had been my land and I had the details I would have most definitely forwarded them to the EPA to initiate action. Illegal dumping of rubbish is precisely that and should be stopped.

    Offenders such as the person you talk of needs to be aware that the penalties if proven can be very high indeed and no smart solicitor could get him off if one had sound evidence. The courts these days as well as the EPAs Nationwide take such matters very seriously. Dave

    I've reported sever pollution events to EPA on several occasions. only to get told to contact Council. The council says contact EPA.....don't waste your breath.

    It may not have come from the police raid....I kinda doubt that they would ditch things before a matter has gone through court.

    You may have just missed a chance to get your illegal dumper busted on several counts.

    Wouldn't occur here since such matters are dealt with by us, under our new Litter legislation. We even go after people who throw cigarette butts out. Everything from Warning Notices, to simple fines to even prosecutions for serious offences and where have substantive evidence !!
