    Default Timber Between Borders

    G'day all,

    I had a quick search but couldn't find the answer I was looking for (if in doubt keep asking til you get the right one)

    If I had a mate in tassie doing some land clearing, and I happened to be passing through are there rules/regulations on if I shipped my car down there, loaded up some choice logs, then shipped it back to Melbourne; Or if I was going to NSW for a trip and found some timber by the side of the road is it illegal to bring it home with me?

    I guess if it was seasoned then it woudln't be an issue (like most suppliers being able to send pen blanks etc in the mail)

    just an inquiry, I don't actally know anyone clearing land in Tassie (sorry guys, I know a few of you were about to ask where/when)

    As far as I'm aware, there is no restrictions on moving timber between states including Tassie. An old mate of mine in VIC used to hook the trailer up to his ute, cross the strait to Tassie fill the ute and trailer up with timber from various merchants than back home over the weekend.

    Timber coming into Tassie has to be declared but as far as I'm aware not the other way

    This, from the Australian Constitution, probably answers your question.

    Commonwealth of Australia Constitution Act

    92 Trade within the Commonwealth to be free
    On the imposition of uniform duties of customs, trade, commerce, and intercourse among the States, whether by means of internal carriage or ocean navigation, shall be absolutely free.

    That clause doesn't stop States imposing quarantine restrictions etc, which I think is what the original question was about.
    Think the ban on bringing fruit etc in to SA.

    Another one from the Australian Constitution which states that Commonwealth law overrides state laws, if there is any inconsistency.

    Commonwealth of Australia Constitution Act

    109 Inconsistency of laws
    When a law of a State is inconsistent with a law of the Commonwealth, the latter shall prevail, and the former shall, to the extent of the inconsistency, be invalid.

    Some years back, going overto Tas on the boat, there was a fella with a trailer load of flooring. They wouldn't let him on. Guess they didn't read the constipation either.
