I would get the ball rolling now. Did you pay through PayPal? That way you will get your money back.

I could be wrong, but I think the time imit for a claim through Paypal is 30 days, and the time limit through Ebay dispute console is 60 day.s

It was not through paypal so that is why it bothers me. Tameriska, you are right it is 60 days for ebay so I have plenty of time, that is why I thought maybe I should wait another week, maybe I am just too trusting, the seller does have a good reputation though looking at his feedback.

I had a similar problem and so you can "request sellers details" which got me their phone number. Not that it did any good.
That mob built up a good feedback and then deliberately ripped off 20 of us in one hit. Eventually Ebay deregistered them, they have since re surfaced twice that I know of. Regardless of feedback, Ebay is a risk unless you can pick goods up directly.

Having said that I still use it, 2 bad experiences so far tho.

Way I see it, it is not hard to access email elsewhere (public library etc). So if they have email problems, why no reply in 3 weeks?

By not acting now, you are only delaying the whole process, and in the meantime he is free to inflict the same thing on other unsuspecting ebayers.

There is nothing lost by starting the dispute process, it may make him reply, in which case everything is sweet. If not, what have you lost? If you start a dispute because of non-delivery, he can't leave negative feedback.

He hasn't sold or listed any stuff since and has not had any activity such as posting feedback. That is what makes me think he may be away or there is some problem. I will initiate the process and hopefully be able to get some other contact details, otherwise I may have to tap a few low people in high places on the shoulder and see if they can find a contact number.

You could leave a message in his Feedback that might spark him because everone would see it not good for him but then he should of took care of you

As Tameriska said, Ebay will supply you with contact details on request.

Don't leave negative feed back before the dispute is official, that way he could retaliate and give you negative feedback.

I have taken the advice and initiated a dispute request for an item not received. The seller has 10 days to respond before ebay will take further action.

I am pretty protective of my feedback so would not like to leave negative in case they just responded in kind, I would lose twice then and still not have the gear I paid for.

We had a seller send something that was NOTHING like what he was advertising and wouldnt respond to emails through ebay so got onto ebay and at the same time posted negative feedback he rang me the next day didnt tell me why he hadnt returned my emails got really quite conserned that I wouldnt take off the negative feedback and went on to promise to send me the true item (which he did via express courier at his cost) and refunded the costs through paypal then ebay contacted me and the negative feedback was recinded and a new neutral feedback given.

Ebay were on the ball.

As it seems he is in Australia, you CAN always go to the 'Fair Trading' if he is a buisness, or the Police - it is only a small fraud/theft from you this time, but it might convince him to desist if the 'Boys in Blue' come knocking.

My view on this would be that there is no theft or fraud at this point. This is a civil matter purely and simply and there would need to be one heck of a lot more overt actions before it became a crime.

Pure and simple, this is a contract between two parties, one side offering for sale, another offering to buy. Doesn't matter that the buyer has paid over money or that the seller has failed to hand over the goods, that in itself does not make it a theft or a deception.

No copper will get involved in taking sides in a civil matter and if they did there would be legitimate grounds for complaint.

I don't know where the seller or the buyer are, but here in Victoria, using a computer to assist in a crime is a summary offence and there is no possibility of legally directing the service provider in another state to supply the name and address of the owner of the computer from where the computer transmissions originated from.

Even if there was evidence to suggest that a theft or deception has been committed, there is zero, nil, none and Buckleys of getting a defendant extradited interstate over this type of matter. Like it or not, cost is the over-riding factor here.

I have not heard from him as yet and he has not responded to ebay which being the trusting fella I am makes me think he has a genuine problem and has not been online. As I did not specify registered post and he did not state whether or not it would be registered, just said he would post anywhere for $20, I am guessing all he has to do is say he posted it and Aust post lost it and that is the end of it. People who lie about that sort of thing and work that way don't maintain a good reputation on ebay for very long, so with his reputaion as it is (good) I guess I would have to believe him and accept it.

Dingo, I had a feedback removed as well because and old bloke who was an ebay newby checked the wrong box on the feedback form. I contacted him and he was very sorry and embarrassed about it so we contacted ebay and they removed the negative. Bummer is when you remove negative you get left with a "rating mutially withdrawn" so that is what I was left with while he got a positive.
